我国社区矫正模式的省思与完善

社区矫正在我国具有良好的发展前景,但其适用规模应与现实国情相适应。在社区矫正本土化的实践中,"过柔"的感化做法损伤了社区行刑的惩罚性质。在立法模式上,社区矫正宜采取"先下后上"的路径,并应引入社区矫正官制度。我国尚欠缺发达的社区模式与成熟的社区构造,故社区矫正不宜无限制地扩张适用。目前,社区矫正面临精细化与程式化的技术要求。社区矫正与监禁矫正实为相辅相成的关系,两种矫正方式应力求实现互动衔接。

On the Introspection and Perfection of Community Correction Mode in Our Country

Community correction has a promising development in China, but the suitable scale should be in line with realistic national conditions. In the practice of community correction localization, the ＂too light＂ influence behaviors make damages to the punishment nature of community execution. On the legislative mode, the community correction should take the path of ＂down first under on＂ , and the system of community correctional officer should be introduced to our country. The developed community model and mature community structure are still not enough in our country. As a result, the application of community correction should not be expanded without limitation. At present, our community correction is faced with elaborate and stylized technical requirements. There is complementary relationship between community correction and jailed correction, and they should try to realize cohesion and dynamic interaction.
