人本主义法学视野下的国家法与民间法

国家法应尊重体现人的善良意愿的民间法,宽容体现人的弱点的民间法,认可有利于维护和谐秩序的民间法,吸收有利于减轻人的痛苦的民间法,禁止加剧人的痛苦的民间法。在不违背社会公共利益的前提下,国家法应最大限度地尊重人们选择适用民间法的权利。发挥民间法的作用有利于防止国家法的异化。同理,发挥国家法的作用也有利于防止民间法的异化。建立包括国家法与民间法的多元规则体系有利于为人们营造一个宽松和谐的良好环境。

Under the Humanism Legal Science Field of Vision of National Law and folk Law

The national law should respects and manifests person's folk law in good will,tolerantly manifests person's weakness in folk law,the approval is advantageous to the maintenance of harmonious order in folk law,the absorption is advantageous to reducing person's pain in folk law,the prohibition intensifies person's pain in folk law.It does not violate the social public interest under the premise,the national law should maximumly limit the respect of the people to choose is suitable to folk law right.The display of folk law function is advantageous to prevents the national law's disassimilation.The same principle,the display of the national law function is also advantageous to prevents the folk law's disassimilation.The establishment including the national law is advantageous to folk law in many regular system to builds a loose harmonious environment for the people.
