论驰名商标的特殊法律保护

我国2001年新修订的<商标法>首次以法律的形式明确规定了驰名商标特殊保护的内容,使驰名商标的认定与特殊保护工作真正有法可依,与国际公约和发达国家的立法保持了基本相同的保护水平.有必要结合相关国际公约和他国立法、以及我国立法的实践情况,对驰名商标的特殊法律保护制度从理论上进行系统整合,以期在今后更好地维护公平竞争,保护驰名商标所有人和消费者的合法权益.

On Special Legal Protection of Well-known Trademarks

For the first time in China, special protection for well-known trademarks was stipulated in the newly amended Trademark Law in 2001. Thus the confirmation and special protection can be done according to the law, which accords with the international treaty and developed countries' legislation. It is necessary to systematize the system of special protection of well-known trademarks based on related international treaties, other countries' legislation and our country's actual situations.
