“区域限行”法律问题研究

为应对当前机动车保有量的激增所引发的城市交通压力，各地方政府以“区域限行”为主的交通管制行政措施应运而生。区域限行作为行政行为在法律属性上应定性为行政决策行为。在合法性要件上应当满足法律保留原则、明确性原则、比例原则和平等原则。鉴于当前各地现行的区域限行措施符合法律保留和法律明确原则，故对于其合法性的可能控制应着重通过决策程序的设计来进行。

A Study of Law on Regional Traffic Limitation

To resolve the problem of increasing pressure of urban traffic, local governments currently adopt traffic control named ＂ Regional Traffic Limitation＂. As an administrative behavior , Regional Traffic Limitation should be defined as the administrative decision - making behavior in the legal attributes. It should meet the principle of legal reservation, the principle of specificity, the principle of proportionality and the principle of equality in the legal requirement. At present, measures of Regional Traffic Limitation have met first two principles. Its legitimacy should be strengthened by the construction of administrative procedure of legal system.
