论法的基本价值

法作为一种社会规范现象,其内涵丰富,具体存在形态和具体运行极其复杂。法的价值是多方面的,其中最基本、最核心的价值是正义和秩序。正义是人类共有的内在精神,是法的实质价值;秩序则是人类共有的外在需要,是法的形式价值。正义寓于秩序之中,又通过秩序得到了保障。正义和秩序体现了法的共同理想和目标。法应当是正义和秩序的结合体,法应旨在创设一种正义的社会秩序。

On the Basic Value of the Law

The law,as a phenomenon of social norms,is rich in its connotation and is extremely complicated in its concrete existing form and concrete operation.The seeking of the law's value involves many respects,among which justice and order are the key values,for justice is a commonly-shared internal spirit,the essential value of the law,while order is a commonly-shared external need,the formal value of the law.Justice is contained in order,and guaranteed through order.They two embody the common ideal and target of the law,so the law should be nothing but combination of justice and order,aiming at creating a just social order.
