| 摘 要： | 代理制度是商品经济高度发达的产物。随着我国经济的发展与繁荣 ,在我国对外贸易中出现并形成了外贸代理制。但是 ,在我国新《合同法》实施以前 ,由于我国市场经济法律制度的不健全和不完善 ,使得外贸代理制的推行遇到了阻力。新《合同法》的颁布实施有效地解决了这一问题 ,因而对推行我国外贸代理制产生了积极的影响

| Abstract: | The agent system is a product of highly developed commodity economy. With the development of Chinese economy, the foreign trade agent system has appeared and grown in China. Because of the imperfection of Chinese market economic legal system, the foreign trade agent system met with resistance before the new Contract Law was put into force. The enforcement of the new Contract Law has effectively solved this problem, and therefore has a positive effect on the carrying out of foreign trade agent system. |
