| 摘 要： | 在校未成年学生人身伤害事故应包括教育活动、教学设施、学生间事故和第三方致害事故等。学校承担的赔偿责任是一种法定的教育、管理和保护责任,其承担法律责任的前提是“未尽职责范围的教育、管理和保护义务”,其免责事由主要指“外来原因”。我国《民法通则意见》第160条和最高人民法院《人身损害赔偿司法解释》第7条两个条款,显得过于原则和简单。
