人民主权内涵新释

以博丹主权思想为渊源的卢梭的人民主权理论,由于无视并竭力回避公民之间利益协调的困难,存在着高估国家统一有序、压制公民个性的严重弊端。传统社会主义在追求人类的同质性理想的道路上,无疑承继了卢梭的以抽象"人民"掩盖、压制公民差异性的人民主权理论,难以协调主权与人权的对立统一关系是它的必然结果。因此,只要我国依然存在着官僚主义的官场作风、严重的腐败等体制性弊病,那么,如何在国家统一与尊重公民个性的基础上重新诠释人民主权的内容与形式、探讨政治体制的改进,就应该始终成为法学理论研究的一个重要课题。

Analysis of Connotations of Popular Sovereignty

Rousseau’s theory of popular sovereignty, based on Bodin' s sovereignty as a source of ideas,had serious shortcomings in its overestimation of national unity and order and its suppression of civil personality. When the traditional socialism pursued the homogeneous human ideals, they undoubtedly inherited Rousseau’s theory of popular sovereignty, which was covered up by abstract " people," and suppressed civil differences. The result was that the difficulty in coordinating the unity of opposite relationships between sovereignty and human rights. If China retains the system drawbacks in bureaucratic working styles and severe corruption, then it will always remain an important topic in legal theory research to reinterpret the contents and forms of the popular sovereignty and explore how to improve the political system on the basis of integration and respect of the civilian personality.
