| 摘 要： | 从法的目的和法的价值实现两方面衡量,法律实施效果有经济效益和社会效益两种评价标准.经济效益可以用货币量化的计算,社会效益则由公平、正义、公民自由等抽象的概念衡量.法律的实施受多种因素的影响.对其中制度性影响因素的研究对我国法律的实施有尤其重要的意义.制度分为内在制度和外在制度.通过制度的构建、完善可提高法律实施的效益.制度完善中有本土化和多元化的需求.

| Abstract: | The effect of the law practice can be measured by the criterion of efficiency, including social efficieny and economical efficieny. The effect of the law practice is influenced with many factors. We should pay more atten-tion to the institution factor. The institution can be divided into internai institution and external institution. There are multiways to solve the dispute. To reduce the cost,we can put ADR and other original method into use. |
