| 摘 要： | 随着全国沿海城市“征海”现象的逐年增加，海域使用权因公益提前收回及补偿问题越来越突出。《中华人民共和国海域使用管理法》对因公益提前收回海域使用权及补偿仅进行了原则性规定，其他相关法律法规在此方面的规定也较少。针对实践中出现的因公益提前收回海域使用权的突出问题，以个案分析与理论梳理相结合的方式，对因公益提前收回海域使用权的性质、限制及补偿机制等展开研究。

| Abstract: | With the increasing of taking back the right to use sea area in coastal cities year by year,the problems on taking back the right to use sea area ahead of schedule for public interests and its compensation are becoming more and more outstanding.Only regulations of principle on taking back the right to use sea area ahead of schedule for public interests and its compensation are specified in Administration on Using Sea Area of People's Republic of China,and few regulations on it are specified in the other law... |
