东京审判中的反对意见浅析

东京大审判是战后针对日本甲级战犯而进行的一次重要的军事审判。由于东京法庭的法官来自不同的国家 ,加上各国对战争的感受程度及适用的法律体系不同 ,审判中出现了尖锐的反对意见 ,其中印度法官帕尔的反对意见尤为典型。他将其狭隘的民族主义与日本帝国主义及其侵略战争混为一谈 ,竭力为日本帝国主义辩护 ,为日本战犯开脱罪责。其意见虽未被采纳 ,但却留下了长期而严重的负面影响 ,是当今日本蠢蠢欲动的右翼势力复活、发展的一个精神动力 ,也算是日本至今不承认、反省其侵略战争罪行的原因之一

Analysis on the Counterviews of the Tokyo Judgment

The Tokyo Judgment was a great military trial in which the most serious Japanese war criminals were tried.Cause the judges came from different countries and the law systems of the countries were different as well,acute counterviews existed during the trial and the Indian lawyer--Pal's counterview was the most typicd one.Pal mixed his narrow nationalism with the imperialism of Japan and its aggeression try to defend Japan and to reduce the war criminals'guilt.Though his view was not adopted,perennial and serious influence was left.It has been a spiritual impetus for the revival and the development of the Japanese far-right force.And to some extent,it has also been one of the reasons for Japan to deny its aggressive war till now.
