宪法的结构模式可以分为抽象性的和现实性的两种。前者侧重于维护宪法的形式化地位和精神内容 ;后者重视宪法规范的设立与其实践运作。在中国法制建设向法治建设迈进的大背景下 ,我们正致力于使抽象性的宪法模式向现实性的宪法模式转变。把握结构转换中的运作方式和转换特征是十分必要的 ,而其中基础性的工作是要将两种宪法中对应结构类型予以初步把握。

A Probe into the Modes between Abstract Constitution and Practical Constitution

The composition modes of constitution can be classified into two types--the abstr act and the practical: the former stresses the formalization and essence of constitution, the latter attaches importance to the standardization and practical operations of constitution. While China is stepping from legal construction to "rule the country by law," we are striving for a constitutional transformation from the abstr act to the practical. Therefore, in the process, it is of necessity to recognize the operating methods and features, and as the basic work, we should tentatively grasp the corresponding compositions between the two types of constitution.
