| 摘 要： | 发展低碳经济需要创新的法律制度作为支撑。我国低碳经济的发展需要从碳排放的事前、事中和事后3个方面进行法律规制。碳减排事前规制的目标是发展清洁能源,要求是:调整国家能源规划,科学处理可再生能源与清洁能源的关系;增加财力和智力投入,加强清洁能源的科研和开发;确立清洁能源强制配额制度,为清洁能源的发展拓展空间;改革价格制度,提升清洁能源的竞争能力;改革知识产权制度,激励清洁能源的技术创新。
