| 摘 要： | 亲属身份法益是民事主体基于特定亲属身份关系而产生的、与人身不可分离的合法利益。亲属身份法益的专属性、对世性,因其绝对权性质而享有身份法益侵害之请求权。亲属身份法益侵害属一般侵权行为,适用过错责任原则。2009年颁布的《中华人民共和国侵权责任法》肯定了亲属身份法益受到不法侵害时的损害赔偿诉讼请求权、诉讼主体和损害赔偿范围。

| Abstract: | The legal interest of relative status originated from the civil subject that based on customized relationship of relative status.It is a legal interest inseparate with persons.The exclusive and sociality of the legal interest of relative status,due to its character of impreium,enjoys the right to claim on the infringement of the legal interest of its status.The infringement of the legal interest of relative status is classified as general infinging act,which applies to the principle of fault liability.It is affirmed in the Law of Infringement Liabity（promulgated in 2009） the right to claim on the litigation of harm compensation,the litigation subject,and the scope of the harm compensation during the illegal infringement of the legal interest of relative status. |
