| 摘 要： | 单位累犯是一个客观存在着的犯罪现象,刑法上必须对此作出立法反映,以弥补立法漏洞。对单位累犯的概念进行了探析,对“单位中责任人重罪说”与“自然人重罪说”两种观点进行了批驳,并在基本肯定“单位重罪说”的基础上对该说提出了修正。在此基础上,对单位累犯的类型、成立条件以及处罚原则等问题进行了探讨。

| Abstract: | The Criminal Law in 1997 doesn't give a clear definition of cumulative offenses by a unit. In fact, cumulative offenses by a unit is an objective phenomenon that must be stipulated in criminal law to make up this defecit. On analyzing the conception of cumulative offenses by a unit, this paper first refutes the views that cumulative offense is based on the felony by the person liable, or on the felony by natural person. Then it amends the theory of felony by a unit. Furthermore, it studies the types, conditions and principle of punishment of cumulative offenses by a unit in order to give some advice on perfecting the legislation of cumulative offenses by a unit. |
