| 摘 要： | 对于加害人不明的建筑物抛掷物致人损害案件纠纷解决，是我国司法界的难题，《侵权责任法》第87条规定在一定程度上解决了该问题。结合国内外相关立法例．从我国国情实际和法律文化传统以及当事人双方利益平衡角度，让可能致害的建筑物使用人承担适当的按份补偿责任是合理的。

| Abstract: | Throwing objects from the building when the inflictor is uncertain is a problem in our country＇s judiciary. Article 87 of the Tort Liability Act seems to solve the problem in a sense. Referring to the relevant legislative eases at home and abroad, and considering the practical and legal culture in China＇s national conditions and traditions and parties＇ benefit balance, it＇s appropriate to make the property users assume liability in proportion. |
