| 摘 要： | 从网络交易平台的法律性质着手,以＂淘宝网＂为例,重点对其民事法律责任进行类型化分析,即从侵权责任和契约责任两部分入手,探讨其民事责任认定中的相关难题,并比较世界各国的立法经验和规范方式,提出对当前第三方网络交易服务平台商予以规制的法律策略和方法。
