作为工具的法律与作为目的的法律——近现代法律的"目的论"与"工具说"

一个社会若要形成稳定的法治社会，法律的目的性必然超载它的工具性。而这种目的性必然是个人与社会的共同发展，建立在人的发展之上的社会的发展。脱离开这一目的性，或是各个法律间不能构建同一的目的性，法律治理是不可能的。马克思的法学思想与西方的法律传统在这一点上是共同的，法律需要有这样的目的：这是西方传统的法律精神。如果这种目的性丧失了，法律与法治就毫无意义可言，这是马克思法学思想的核心。社会中人的发展是这两种思想的核心。因此，将目的说与工具说并列起来，或者将二者对立起来的看法与做法其实是对马克思思想与西方传统的误解与误读。法律确实是具有“剑”（暴力）的特性，但是它是掌握在“正义女神”的手中，它是从属于法律的目的性，如果没有了目的性，只剩下单一的暴力性，法律治理的时代也将终结。工具说不足以成就法律的治理。
