| 摘 要： | 正当程序是西方宪政与法治传统中极其重要的理念和制度,深受自然法思想的影响。通过对自然法历史追溯和功用阐释,解析正当程序的法哲学基础,探寻其何以有价值及有何价值,为深入研究正当程序理论和完善我国法治建设提供有益的借鉴。

| Abstract: | Due Process is the important idea and system in the tradition of the constitutionalism and the rule by law in western countries. It is greatly effected by the idea of Natural Law.The paper traces back to the history and function of natural law,analyses the foundation of philosophy of law and illustrates why and what the value of Due Process is, in order to provide us with useful lessons in Due Process research and construction of rule by law in China. |
