| 摘 要： | 行政强制执行是行政行为的重要内容之一，但对于行政强制执行权的归属与分配在理论界争议颇大。笔者认为，要消除我国现行行政强制体制的弊端，应当实行“以行政机关自行强制执行为主，以申请人民法院执行为辅”的强制执行体制。

| Abstract: | Administrative enforcement,though an important part of administrative behaviour, arouses big controversion when it comes to its belonging and distribution. According to the author, to remove the corrupt practices of the administrative enforcement currently enforced in China asks for a system of administrative enforcement which ＂depends mainly on administrative enforcement enforced by administrative organs themselves, and is supplemented by applying for enforcement by people＇s courts＂. |
