"宽严相济":和谐社会语境下职务犯罪立法的定位与选择

在打击职务犯罪过程中贯彻宽严相济刑事政策是构建和谐社会的题中应有之义。我国现行的职务犯罪立法存在着贪污罪构成标准过高、渎职罪成立条件过严、贿赂罪法网设置过松及死刑作用夸大、资格刑功能错位、罚金刑地位缺失等宽严失调的现象,故应从职务犯罪立法上降低贪污罪的构成标准、放宽渎职罪的成立条件、严密贿赂罪的法网设置及废止死刑、改造资格刑、增设罚金刑。

Combining Severity with Leniency: Job-related Crimes Legislation Positioning and Choice in a Harmonious Social Environment

Carrying out the criminal policy of combining severity with leniency in the course of the fight against job-related crime is proper meaning to build a harmonious society.In China's existing job-related crimes legislation,there exist such phenomena as a high standard for the crime of corruption,the establishment of the crime of dereliction of duty unduly strict conditions,the loose net of justice for bribery crimes,the exaggeration of the role of the death penalty,the penalty function eligible dislocation and the penalty status of deletion.Therefore,the standard for the crime of corruption must be lowered;relaxation of the establishment of conditions for the crime of dereliction of duty must be relaxed;the net of justice for bribery crimes must be set up strictly.The death penalty must be abolished;the eligible sentence must be transformed and penalties must be added.
