| 摘 要： | 法律思维是法律人最为重要的思维形式，其直接或间接地影响着人们对法律的基本判断。文章在对法律思维本体构成要素解析的基础上，着重提出了我国在法治建设进程中所遇问题现象与本质的关系。对于传统法律思维模式和现行体制中泛政治化思维倾向，文章也从法律思维养成的路径上进行了有效的微观上的探讨。
