| 摘 要： | 20世纪初,晚清政府推行司法制度改革,内容大多来源于西方近代法律的移植,尤其主要以德国法为蓝本.这场法律移植活动是一次有益的实践,它使中国传统的司法制度发生了历史性的变革,迈上了近现代型的发展轨道,并且成为其后"中华民国"立法的重要渊源.

| Abstract: | At the first of 20th century,in order to reform the judicature, the Qing government transplanted the west laws on a large scale, especially the laws of Germany. The action of transplanting laws is a valuable practice,which made the traditional judicature changed historically furthermore.It was the important sources of law in the Republic period. |
