| 摘 要： | 奥斯丁的"命令论"的根本问题,在于没有给规则应有的地位.由此,哈特将规则引进法律本体之中.但是,只有义务规则的社会,其规则体系存在着严重的缺陷,而这些缺陷的克服必须依赖于义务规则之外的授权规则.由于授权规则的引入,不仅可以有效地克服单纯义务规则导致的诸多缺陷,更重要的价值还在于通过授权规则与义务规则的结合,一种新的法律本体论,即法律是义务规则与授权规则相结合的"规则论",开始浮出水面.

| Abstract: | The order theory of Austin had a fault that had not taken the rules seriously. Hart thought the rules as law. System of rules could not work better by duty rules only. So the empowered rules must been take in. A new ontology of law grow out from the mixture between the duty rules and the empowered rules. |
