香港地区规制危险驾驶的立法现状与启示--兼论大陆危险驾驶罪的缺陷与完善

基于历史和法律传统，我国香港特别行政区对于危险驾驶的法律规制具有显著的英美法特征，即通过单行立法的模式，逐一解决法律适用过程中层出不穷的危险驾驶行为。同时在不断修订以《道路交通条例》为代表的法律文本的过程中，确立了对于危险驾驶行为较为完善的认定标准和裁判规则。反观我国大陆关于危险驾驶的法律规范，囿于前瞻性的欠缺和立法传统的影响，使得对某些危险驾驶行为缺乏合理和及时的处理措施。鉴于危险驾驶在社会情势上的趋同，以香港特别行政区的立法内容和司法实践作为参考，将为我国大陆完善危险驾驶行为的相关立法，提供较为合理的样本。

The Actuality and Revelation of the Dangerous Driving Legislation in Hong Kong---From the Perspective of the Deficiency and the Perfection of Dangerous Driving Legislation in Mainland China

Based on the history and legal tradition,the legislation of Dangerous-driving in Hong Kong Spe-cial Administrative Region （HKSAR）has the characteristic of Anglo-American Law.It utilized the mode of Lex Specialis and resolved the pattern of Dangerous-driving acts.Through revising the Road Traffic Ordinance,the legislation of HKSAR established the criterion of ascertaining and judge rule.The legislation of dangerous-driving in Mainland China lacks a forward insight and the traditional influence of Continental Legal System.The penalty of dangerous-driving acts lacks reasonable and prompt measure.In view of the same social situation,referring to the legislation of HKSAR would provide reasonable sample to perfect the legal system of Mainland China.
