司法公正观的验算与型构--基于法院自评、人大票决和公众调查的三维考察

司法公正是一个人人都在言说，但处处不易实践的社会难题。站在不同的立场与角度，每个人对公正有着不同的理解与看法。根据最高人民法院提供的数据分析可见，法院本身、全国人大、社会公众对司法公正做出了差异较大的评价。对司法公正的不同评价有着文化观念、制度不足和机制错位等多方面的原因。在现代法治国家，社会各界应当对司法公正达成认识上的一致，否则司法公正这一词汇永远不能指代它所能代表的对象与观念。因此，司法公正需要理念上的倡导和实践上的型构，以弥合各界在认识上的差异。

Checking and Framing of Judicial Justice in China-A Three-dimensional Research based on Court Self-assessment,NPC’s Voting and Public Survey

Judicial justice is a thing that can be talked about by almost everyone,but it is at the same time a social issue difficult to put into practice.Judging from different perspectives,people’s interpretations and o-pinions about judicial justice vary.According to the analytical data offered by the Supreme Court,the Court it-self,the NPC and the public all have made different evaluations about it,which may have been due to different cultural values,deficient systems and lack of institutional mechanisms.In the modern states governed by law, the common understanding on judicial justice shall be reached between every social sectors,otherwise,the term“judicial justice”would never be able to fully display the objectives and concepts it represents.Therefore,con-ceptual advocating and pragmatic framing are needed to bridge the differences in the understanding of judicial justice.
