我国建立环境污染强制责任保险制度的可行性探析

实行环境污染强制责任保险与企业社会责任理念相契合,投保环境责任保险是企业承担社会责任的方式之一。我国于20世纪90年代初开始试行环境污染责任保险制度,经历了从责任保险到强制责任保险的发展历程。近年来政府出台了一系列促进环境污染责任保险制度发展的规定,为该制度构建奠定了政策基础。我国在船舶油污强制责任保险和交强险方面的立法和实践可以为该制度构建提供参考,同时在保险模式选择上可以借鉴西方国家成熟的环境责任保险制度。

Analysis on the Feasibility of the Compulsory Liability Insurance System of Environmental Pollution in China

Implementation of the compulsory liability insurance system of environmental pollution corresponds to the concept of corporate social responsibility, and it＇s one of the ways for enterprises to undertake corporate social responsibility.China has been carrying out liability insurance of environmental pollution since the beginning of 1990 s. The system has been developed from the liability insurance to the compulsory liability insurance. In recent years, the Chinese government has issued a series of documents for improving the development of the compulsory liability insurance system of environmental pollution and laid the policy basis for the construction of the system. In China, the legislation and practices of the compulsory liability insurance of ship oil pollution damage and traffic accident can provide reference for the construction of the system, at the same time we can draw lessons from western countries on the mature insurance model selection.
