良法价值构造论

“依法治国”的实质是“依良法治国” ,良法价值构造问题是一个重大的理论课题与急需解决的现实课题。从法律价值的理论视角来看 ,法律的优越品性与功能是良法价值构造的客观依据 ,法主体的利益需要是良法价值构造的主观动因 ,而法律的创制活动则是良法价值构造的现实途径。确立一种合理的立法体制、正当的立法程序与有效的立法监督机制是保证“立法”之“法”为“良法”的制度基础。
