| 摘 要： | 随着软法理论的不断发展,软法的研究逐渐渗入到诸多传统公法领域专题之中。但是,目前以软法视角审视我国《民族区域自治法》的研究成果仍尚付阙如。事实上,《民族区域自治法》中存在着大量的软法性条款,它们在民族区域自治制度的发展过程中扮演着重要的角色,却也在当前遭遇到了前所未有的实施困境。深入剖析软法的基本理论以及《民族区域自治法》中软法现象的表现、成因、实施现状和障碍,将为有关软法性条款效力的充分发挥乃至民族区域自治制度的进一步完善产生巨大的推动作用。
