| 摘 要： | 惩罚性赔偿制度是一项早期仅适用于英美法系国家的特有制度,具有补偿受害人的损失、惩罚和威慑不法行为等多重功能.通过考察惩罚性赔偿在英美法系国家侵权领域适用的变迁,本文就其在我国侵权法领域适用的合理性与适用的条件、范围、赔偿额度等若干问题略作探讨.

| Abstract: | Punitive damages is only one of the le gal systems initially applied in the common system,which can compensate vic-tim for the loss,punish and deter inj uries from behaving against law.By e xploring the process of the application of punitive damages in the common syste m,this passage probes into the ratio nality and some question such as prim es,range,degree about its application in the field of infringement law in China. |
