社会转型中的制度公正问题的反思

社会转型过程中一个最为突出的问题就是社会公正问题,而社会公正的本质是制度公正。本文从一个综合视角对制度公正问题进行了深刻的反思,认为许多社会不公正现象是由一些不合理的制度安排所造成的,而影响制度公正的因素是多方面的,因而从任何单一视角对制度公正根源探究注定会陷入困境。因此解决不同领域制度公正原则的冲突,从整体上寻找一种带有普适性的制度公正原则,是走出制度公正困境、从而也是真正解决社会生活中的不公正问题的良策。

During the social transformation a most outstanding problem is the social justice,and its essence is the institutional justice.This article profoundly rethinks the problem of the institutional justice from a synthetic angle of view,thinks that some unreasonable institutional arrangements resulted in a lot of the social unjust phenomena.And that the factors influencing the institutional justice are all round,thus any exploration of the parentage of the institutional justice from a single angle of view is doomed to be in hot water.Thereby resolving the conflict of the principles of the institutional justice in different fields,and looking for a general principle of the institutional justice from the whole are the good plan of walking out the plight of the institutional justice and resolving the unjust problems in social life in deed.
