网络隐私权对传统隐私权的若干突破

学界正在对隐私权问题进行探讨。网络的出现与发展对传统隐私权的冲击十分明显。论文从网络技术对现实生活影响的角度,分析网络时代对隐私权的新要求,比较其与传统隐私权之间的差距,论述网络隐私权较传统隐私权在权利主体、权利对象、权利属性上的突破。作者认为:网络隐私权的主体不限于自然人;网络拓展了隐私权的对象范围;网络隐私权不再是单纯的人格权,而是人格权与财产权的复合型权利。

New Features of the Privacy Right in tile Internet Times

The issue of privacy rights is being heatedly discussed in the academic field.The invention and development of the Internet has imposed great challenges to the traditional way of interpreting privacy right.This paper,from the aspect of the influence of the Internet technology on people's life,analyzes the necessities of reinterpreting privacy right in the Internet times,compares it with the privacy right before the Internet appeared,and discusses the new interpretation of it on the subject of rights,the range and nature of privacy.The writer comes to a conclusion that the subject of privacy right in the Internet times goes beyond the human beings.The Internet enlarges the range of privacy.It is no longer regarded as a pure personal right,but defined as complex right consisting of personal right and property right.
