| 摘 要： | 对于海域使用权的界定,可从海域使用权的基本概念入手,不仅要从正面界定其法律属性,还要从侧面通过将其与相关涉海权利进行界分来实现。海域使用权的客体具有价值的多重性和资源的复合性,由此决定了海域使用权与相关涉海权利发生冲突的必然性。海域使用权的法律性质之界定应从考察其事实上的特点着手,而不能囿于现行法律对其所作的处理之上。海域使用权与相关涉海权利的区别主要就是用益物权与准物权的区别,二者的效力冲突只表现在一定的海域范围之内,其协调应视这些涉海权利自身的不同情况采用不同的方案。
