| 摘 要： | 为贯彻落实"尊重和保障人权"这一《宪法》基本理念,2012年修改的《刑事诉讼法》建立了捕后羁押必要性审查机制,《人民检察院刑事诉讼规则(试行)》对该机制进行了初步的程序设计。但是,从《刑事诉讼法》修改前捕后羁押监督在司法实践中存在的问题,以及《刑事诉讼法》修改后捕后羁押必要性审查机制与相关制度的联系、区别来看,捕后羁押必要性审查机制的功能定位和程序完善还有进一步探讨的空间。

| Abstract: | In order to carry out the basic concept of respecting and protecting human rights in The Constitution, The Criminal Procedure Law modified in 2012 has established the necessity investigation mechanism for detention after arresting, and Rules for Criminal Procedure of the People＇s Procuratorate （for Trial Implementation） has made prelimi- nary program design for this mechanism. However, before the revision of the Criminal Procedure Law, there existed problems in judicial practice related to supervision of detention after arresting; and seen from the associations and differences between the necessity investigation mechanism for detention after arresting and other related systems, the function and procedure of the necessity investigation mechanism for detention after arresting requires further study and probe. |
