| 摘 要： | 双务合同履行中的抗辨权制度各国立法中均有规定。我国合同法完善了同时履行抗辨权内容 ,增加了履行不当的抗辨权 ,加强了合同对双方当事人的约束力 ,维护了合同履行的公平性。异时履行抗辨权 ,公平地权衡了双方当事人的利益 ,对于促使合同的正常履行具有积极意义

| Abstract: | The demurrer system in the contract fulfilling has been stipulated in the laws of all the countries. The contract law of China perfects the demurrer contents of simultaneous fulfilling, adds the improper fulfilling demurrer, strengthens the restriction on the parties, safeguards the fairness of contract fulfilling. Non simultaneous fulfilling demurrer balances fairly the interests of the contract parties, which is of positive significance to the normal fulfilling of contracts. |
