法律方法中的逻辑真谛

有关法律方法的研究,普遍存在对逻辑真谛的诸多误解或曲解,逻辑形式并非就仅有一个三段论,也并非仅是人类已知的几个推理式,法律方法理应关注更多的已知、尤其未知的逻辑形式。并非复杂的案件不需要逻辑,并非涉及法律内容的思维就叫法律思维,法律内容的特征不能混同于法律思维的特征。当把法律思维跟非形式逻辑扯到一起时,须知"非形式"不是不讲形式,更不是不讲逻辑。法律方法至少应是对法律思维进行逻辑抽象的结果,逻辑抽象未必一抽到顶,是可以分层次进行的,用"分层抽象法"去审视法律思维,将可大大扩展法律方法的研究视野,使成就清晰、独立的法律方法论成为可能。

Logical Essence of the Legal Methods

On the research of legal methods,there are many misunderstandings or distortions on the logical essence.Because logical form is not only a syllogism or the reasoning forms known to man,legal methods should focus on more known logical form,in particular,the unknown ones.Complex cases is not without logic and the thinking related to the legal content is not called the law of legal thinking,therefore the characteristics of legal content can not be confused with the characteristics of legal thinking.When the legal thinking is related to"non-form"logic,"non-form" is neither without a form nor without logic.Legal method should be the result of an logical abstraction of legal thinking.Logical abstraction may not get into the top of a logical abstraction and can be carried out at different levels.We should review the legal thinking with hierarchical abstraction which can greatly expand the research vision and make a clear and independent legal methodology possible.
