摊贩问题的产权经济学分析

本文试图以产权经济学的原理来分析城市中摊贩问题这一顽症,指出其根源是产权错置,并提出相应的重新配置产权的对策。本文提出的对策包括:第一、承认摊贩的设摊权,因为这来自于其天赋的生存权,所要管制的只是设摊产生的负外部性。第二、将环境权和制约摊贩的权利都界定给社区,让相关的外部性在社区层面内部化。第三、摊贩应当对环境的改善享受“剩余索取权”。

Property Rights Economic Analysis for Vendor Problem

This paper tries to analyze the vendor problem in the city with the principles of property rights economics,pointing out the property rights misallocation is its root,and put forward suggestions for property rights reallocation.The suggestions include: First,admit the vendor's right to keep a stall,which derives from his basic human rights,and just regulate the related negative externalities.Second,entitle the community with the environment right and the right to regulate vendors in order to internalize the externalities on the community level.Third,let the vendors enjoy "the right to claim the residual" for environment improvement.
