合法性抑或有效性--对儒、法两家秩序思想的比较

儒家和法家对于秩序的诉求迥异其趣.这些不同主要体现在对君主秩序的来源是否有疑问、对于人性本质的基本假定、对于政治权力的行使所应坚守的原则等方面.但在君主专制"秩序第一"前提下的儒家、法家的分歧,又在这一前提下得以合流和相互补充,从而共同构成传统中国专制制度的核心内容.

Legitimacy or Efficacy--On the Comparison of Order thought between Confucian and Legalist school

There are some differences in the order thought between Confucian and Legalist school in the following aspects: the origin of sovereign system, the fundamental assumption of human nature and the principles in the exertion of political authority etc. However, oil the premise of "the priority of order" in monarchy system, Confucian and Legalist school make up for the divergences and supplement each other so as to constitute the core of traditional Chinese autocracy together.
