| 摘 要： | 为了使GATS对这种全新的商业模式——电子服务进行有效地规制,通过实证分析方法研究了GATS在规制电子服务中遇到的种种问题,认为解决这些问题的方法有四种,即依赖于GATS的现有框架、修订GATS现有规则、对GATS增加一个新的文本和对WTO文本进行水平改革,通过比较分析并极力主张以GATS附件的形式构建一个电子服务协议。

| Abstract: | In order to effectively regulate a new commerce mode:electronic service, the article analyse those barriers confronted with GATS by positive analysis, proposes four solutions to the barriers, that is, relying on the existing GATS Framework,revising the GATS Principles,adding a New Global Electronic Commerce Instrument to the GATS,pursuing horizontal reforms of WTO Instruments and by comparison points out that an agreement on electronic service should be constructed in the form of GATS annex. |
