探寻刑罚伦理价值目标

社会秩序对于一个国家的存在与发展来说固然是必不可少的,但是如果人们过度崇尚用刑罚的强制力保障秩序,忽视伦理在预防和控制犯罪方面所起的广泛的、深远的作用,那么再严密的刑事法律和政策在犯罪浪潮面前,只能力不从心。因此国家刑罚权的实施应建立在伦理价值的基础上,做到最少的刑罚维护社会秩序,并最多地保留个人自由领域,力求自由和秩序的合理平衡,实现正义价值。
