| 摘 要： | 特留份制度已经成为很多国家限制遗嘱自由的一项重要法律制度,然而我国尚未建立该制度。通过追溯特留份制度的历史渊源,阐述大陆法系和英美法系一些国家和地区的有关规定,在此基础上予以比较评析,最后结合我国现行立法和现实国情提出构建我国特留份制度的构想。

| Abstract: | Forced heirship has become an important legal system limiting the testamentary freedom in many countries,but no such system exists in China.This thesis begins with the introduction of the history of the system,and goes on with the discussions and comparisons on the relative regulations in the civil law and common law countries.In the end,the legislative suggestions on this system are offered. |
