ON THE CONSTRUCTION OF MENTAL DAMAGE COMPENSATION SYSTEM OF ADMINISTRATIVE TORT IN OUR COUNTRY

Establishing the system of administrative tort compensation for mental damage is an important method of overall effective protection of citizens＂ legal rights, as well as the powerful guarantee in supervising administration by law, and the embodiment of the country and the government＇ s representation of people＇ s interests. The paper believes that with the improvement of the law in our country and the improvement of legal consciousness, there has been certain ideological basis and the favorable domestic and international environment to construct the system of administrative tort compensation for mental damage with Chinese characteristics. Based on the interpretation of the connotation of compensation for mental injury of administrative tort, this pa- per discusses the sufficiency and necessity of the construction of administrative tort compensation for mental damage of our country, and the mental compensation principles and bases of administrative infringement.
