司法语境下的法律人思维

司法公正不但是一种法律意义上的公正,而且是一种证明意义上的公正。司法公正之实现要求司法者应该具有法律人思维,缺失法律人思维的司法者将很难确定法律真意。法律人思维应包含两个层面的内容:在理念层面,法律人应具有区别于普通人的方法论原则;在具体层面,法律人应具有操作法律的实际技能。
