论我国行政赔偿程序的缺陷及对策建议

完善的行政赔偿程序是行政相对人的合法权益在受到侵害后能够依法得到赔偿的重要保障。阐述了我国行政赔偿确认程序存在的缺陷,目前先行处理程序的不合理性,以及相关法律对行政赔偿程序规定的冲突。有针对性地提出设立行政赔偿委员会,在现行行政赔偿程序中引入行政听证程序并进行相应的制度体系建设,建立“一并式”行政赔偿诉讼程序,取消“单独式”赔偿程序,制定一部行政赔偿程序法等建议。
