| 摘 要： | 表见代理制度是民法上的一个重要的制度,我国<民法通则>并未确立表见代理制度,1999年l0月起施行的<中华人民共和国合同法>在第四十九条才规定了表见代理制度.文章试图从表见代理的概念和源流、性质、价值去向、构成要件、类型、构成表见代理条件中关于被代理人(本人)主观上是否是要考虑的因素等方面论述,指出我国目前表见代理制度方面存在的不足,提出了立法建议和设想,以期对完善我国的表见代理制度有所用处.

| Abstract: | The System of Apparent Agency is an important system in civil law.However,General Principles of the Civil Law didn't include it.It was not established until October,1999 when The Contract Law of the People's Republic of China finally ruled it in Article 49.This essay tries to discuss Apparent Agency on its concept,origin,nature,value orientation,elements,types and sub-elements considered by the principal subjectively.In this way,the essay may discover some deficiencies of the existing system and make some suggestions and presumptions for the legislation.The improvement of the system can,in the regulatory systems exercising our country's market economy,help raise its credit degree and the safety of trade to better the market economy and protect the legitimate interests of favor-intended counterpart.This essay may contribute to the above aspect. |
