| 摘 要： | 刑事立案监督，是指检察机关对刑事立案主体的立案活动是否合法进行的法律监督。立案监督是检察机关对刑事诉讼法实行检察监督的重要组成部分，与侦查监督、审判监督和执行监督等共同构成完整的刑事诉讼监督体系。立法规定的欠缺和实务中的不规范，使得检察机关的立案监督权难以落实，刑事个案的立案监督流于形式。进一步厘清和准确认识刑事立案监督实践中存在的问题，对于健全我国刑事立案监督机制具有重要意义。
