| 摘 要： | 新刑法对交通肇事罪"因逃逸致人死亡"这一加重处罚情节的规定比较简单,而现实中逃逸致人死亡的行为非常复杂,从而导致理论上和实践上存在大量的分歧。作者以刑法理论为指导,对交通肇事罪中"因逃逸致人死亡"的罪过形式和法律性质以及交通肇事罪中"因逃逸致人死亡"的认定等问题作了探讨。

Thus, there are many differences in theory and practice. With the direction of criminal theories, the author discusses its offense, law's nature and ascertanment. |
