论深化我国国有企业改革的两个突破点--国企改革与所有制关系及其法治化的深化问题

国有企业进行股份制改造、出售等项改革,符合我国多种所有制并存的要求,国企大规模股份制改革不会动摇以公有制为主体的基本经济制度。从产权结构改革而言,所有制为国企改革指明了方向,国企改革是所有制的体现,不是对公有制的冲击,是对我国"以公有制为主体,多种所有制经济共同发展"这一基本经济制度的反映,亦是其他改革成败的关键,是使我国整个改革与我国基本经济制度相互促进的基础。为了充分发挥国企优势,国企还要准确定位,在一些行业或领域有进有退,有所为有所不为。为使国有企业改革与我国所有制切实统一于社会主义本质,尚须国有企业改革法治化的深化,完善立法,提高法治在国企改革中的实施效率。

On the Two Keys to Deepening the State-owned Enterprise Reform of Our Country--Problems on deepening the state-owned enterprise reform,the ownership relation and the rule-of-law process

The paper suggests that the current state-owned enterprise reform concerning the joint-stock rebuilding and the sale of state-owned assets meets the requirements of the co-existence of multi-ownership forms, and holds that such large-scale joint-stock reform cannot shake the basic economic system with the majority of public-owned assets. In terms of the reform of property right structure, the state-owned enterprise reform represents the change of our ownership relation which also indicates these enterprises a reforming way. It reflects the basic economic system "the majority of public ownership with the co-development of multi-ownership forms," serving as the foundation of mutually propelling our essential economic system and the overall reform; thus, it never shakes public ownership, but a key to the success of other reforms. In order to give full play to their advantages, the state-owned enterprises should position their situations precisely and withdraw from some fields for collecting strength. To unify the state-owned enterprise reform and our ownership under the essence of socialism, it is necessary to deepen the rule-of-law process of state-owned enterprise reform, improve legislation and enhance the implementation efficiency of laws in the reform.
