析亟待扩大适用范围的我国行政立法听证程序

行政立法听证程序是指行政立法主体在公布行政规范性文件之前应当告知利害关系人有表达意见、提供证据的机会以及行政立法主体听取意见、接受证据的程序。我国现行行政立法听证程序的适用范围存在缺陷 ,确立行政立法听证程序适用范围应坚持利益平衡、公正与效率相衔接、公开与保密相协调三原则 ,采取立法方式。

Analysis of Applicable Range to Be Urgently Expanded in China's Administration Legislation Hearing Program

Administration legislation hearing program refers to the program that before publicizing regulative administration documents,the principal part of administration legislation should inform relevant parties of the opportunities to express opinions and to provide evidences,and the hearing such opinions and the acceptance of such evidences by the principal party of administration legislation. There are shortcomings in the current legal regulations of Chinas administration legislation hearing program in its applicable range. The establishment of the applicable range in administration legislation hearing program should adopt legislative mode and stick to the principles of balancing interests,matching justness with efficiency,and combining publicity and confidentiality.
