| 摘 要： | 通过运用法经济学的绩效理论，即成本与收益的理论，对传统侵权法理论的主要缺陷、侵权行为发生的原因、归责原则、无形损害赔偿额计算等进行了分析，并运用法经济学的观点提出了降低交易成本、减少外在成本和让侵权行为的损失高于预期成本等预防侵权行为的立法建议。

| Abstract: | The paper analyzes such things as the defects of tort law, cause of fight violating behavior, liability principles and the confirmation of intangible damage indemnification by applying the performance theory, which is the theory of cost and revenue. Based on legal and economic views, the paper also proposes such precautions against fight violating behavior as lowering cost, reducing external cost and making the lost of fight violating higher than expected. |
